Abstract

 

Abortion is a multidimensional phenomenon situated at the intersection of legal, health, and social dynamics. In Indonesia, abortion practices conducted outside statutory exceptions continue to appear in law enforcement records, including within the jurisdiction of the Padang City Police. This study aims to analyze the criminological factors underlying the occurrence of abortus provocatus criminalis and to examine its implications through a socio-legal (empirical juridical) approach. The research employs a descriptive-analytical method. Primary data were obtained through interviews with investigators at the Padang City Police, while secondary data were derived from statutory regulations and relevant scientific literature. The findings suggest that criminological factors encompass both internal and external dimensions. Internal factors include pregnancy outside marriage, the need to preserve family reputation, emotional unpreparedness, and economic constraints. External factors involve family and partner pressure, limited reproductive health literacy, social stigma toward premarital pregnancy, and the availability of unregulated abortion-related drugs. These findings demonstrate that illegal abortion is not merely a legal violation but is also closely linked to social pressure and reproductive health conditions. Addressing this issue requires a balanced approach that combines law enforcement with preventive strategies, including reproductive health education and strengthened social support systems
